What is a "Sanitary District"?

A "Sanitary District" is a special taxing district authorized by the Code of Virginia. The governing body of a Sanitary District has specific powers including:

  • Construction and maintenance of water supply systems
  • Management of sewerage and waste disposal facilities
  • Operation of public utilities and infrastructure
  • Authority to levy annual taxes on properties within the district
  • Power to address public nuisances

How is a Sanitary District established?

The Circuit Court of any County can create a sanitary district upon petition from either:

  • 50 qualified residents of a proposed district, or
  • 50 percent of qualified voters if the proposed district has fewer than 100 qualified voters

Benefits of Sanitary District status:

  • Maintains privacy of community roads, gates, and facilities
  • Establishes uniform fees throughout the subdivision
  • All properties, including developer-owned lots, become subject to district taxes
  • Improved collection rates through County Treasurer's Office (typically 4.3% fee)
