Municipal Water Utility Company FAQ

For more information on your tap water, visit the U.S. CDC:
Fulton City Municipal Water Company and CDC- Who regulates alcohol sales? Texas Alcoholic Beverage Commission (TABC)
- How far must an establishment selling alcohol be from a church or school? A minimum 300 foot distance is required from public/private schools, churches and public hospitals. City Council can grant variances through application.
- Are child care centers included in TABC distance requirements? No, cities cannot adopt such ordinances. Spacing requirements only apply to public/private schools, churches and hospitals.
- How is the distance measured?
- Distances from schools are measured in a straight line from property line to property line.
- For churches or hospitals, measurement runs from the front door of the proposed establishment to the street front. If on the same side, measurement continues along street frontage to a point perpendicular to the church/hospital front door, then from street to that door.
- What are legal hours for alcoholic beverage sales?
- Bars/Restaurants: Monday-Friday 7am-midnight; Saturday 7am-1am; Sunday noon-midnight (10am-noon only with food service)
- Convenience/Grocery Stores: Monday-Friday 7am-midnight; Saturday 7am-1am; Sunday noon-midnight
- Package Stores: Monday-Saturday 10am-9pm; Closed Sundays, Thanksgiving, Christmas and New Year's Day
- Can cities regulate alcohol sales locations? No, but cities can regulate land use and establishments that sell alcohol (convenience stores, restaurants, etc.)
- How can cities regulate such establishments? New proposed uses serving alcohol require a Specific Use Permit (SUP). With SUPs, cities can request upgraded architectural design, site improvements and additional controls including signage.
- Will existing establishments need SUPs to sell alcohol? Existing establishments are grandfathered, but building improvements, site changes or use changes may trigger SUP requirements.
- What is the permitting process? Complete application submission to Texas Comptroller's Office, City review, TABC review, County Judge vote, and final processing in Austin.
- How can I track submitted permits? Track permits at the TABC website: www.tabc.country.tx.us
- If property is annexed, can alcohol be sold there? Beer and wine sales apply only to areas within city limits at the time of the 2008 election. Areas annexed later are considered dry unless residents vote to become "wet."
